These terms and conditions govern your use of the Farm Work Australia website at farmworkaustralia.com.au (also accessible via farmwork.com.au). By using this site, you agree to these terms.

1. About the Service

Farm Work Australia is a job board that connects job seekers with employers offering farm and agricultural work across Australia. We provide the platform. We are not an employer, recruitment agency, or labour hire company.

2. Job Seekers

Registering and applying for jobs is free. You are responsible for the accuracy of the information you provide in your profile and applications. We do not guarantee that you will receive a job offer through our platform.

We are not a party to any employment arrangement between you and an employer. Any disputes relating to employment (pay, conditions, termination) are between you and the employer.

3. Employers

Employers can post job listings by selecting a listing plan and completing payment where applicable. By posting a job, you confirm that:

  • The job is a genuine, currently available position
  • The listing information is accurate and not misleading
  • The role complies with Australian employment law, including the Fair Work Act 2009 and relevant modern awards
  • You will not charge job seekers any fees for applying, placement, or recruitment

We reserve the right to remove any listing that we believe is misleading, fraudulent, or in breach of these terms, without refund.

4. Listing Plans and Payment

Job listing prices are displayed on our pricing page and are in Australian dollars (AUD) inclusive of GST where applicable. Paid listings go live within 24 hours. Free listings go live within 7 days.

Payments are processed through our secure payment provider. We do not store your credit card details.

5. Refunds

Refunds are considered on a case-by-case basis. If your listing has not yet gone live, you may request a full refund. Once a listing is live, refunds are generally not available. Contact us to discuss.

6. User Accounts

You are responsible for keeping your account credentials secure. Do not share your login details with others. You are responsible for all activity that occurs under your account.

We may suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently.

7. Prohibited Conduct

You must not:

  • Post false, misleading, or fraudulent job listings
  • Scrape, copy, or reproduce content from this site without permission
  • Use the site to spam, harass, or send unsolicited messages
  • Attempt to gain unauthorised access to the site or other users’ accounts
  • Use the site for any unlawful purpose
  • Charge job seekers any fees for applying or being placed in a role advertised on this site

8. Content and Intellectual Property

All content on this site (text, design, logos, guides, articles) is owned by Farm Work Australia unless otherwise stated. You may not reproduce, distribute, or republish our content without written permission.

Employers retain ownership of the content in their job listings but grant us a licence to display it on our site and promote it through our channels (newsletter, social media, Facebook group) for the duration of the listing.

9. Disclaimer

We provide the platform in good faith but do not guarantee:

  • The accuracy of information in job listings (employers are responsible for their own content)
  • That any job listed will result in employment
  • That the site will be available without interruption
  • The conduct or reliability of any employer or job seeker using the platform

We are not responsible for any loss, damage, or dispute arising from employment arrangements made through this site.

10. Limitation of Liability

To the maximum extent permitted by Australian law, Farm Work Australia’s liability to you for any claim arising from your use of the site is limited to the amount you paid us in the 12 months before the claim arose. This does not affect any rights you may have under the Australian Consumer Law that cannot be excluded.

11. Privacy

Your use of this site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

12. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated “last updated” date. Continued use of the site after changes means you accept the updated terms.

13. Governing Law

These terms are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of the courts of Australia.
